1751. Carta de don Antonio Merino, canónigo, para doña María Antonia de Castro

The author informs María Antonia de Castro he has received her letter with the information regarding her nephew´s lawsuit and lets her know he is at her disposal for anything she may need.

In May 1751, Domingo Antonio de Angulo y Callejo initiated a litigation against Antonio Merino, a canon from the collegiate church of Toro. Antonio Merino had been the administrator of the profits in the vicinity since 1735, and Domingo Angulo y Callejo asked to be updated of the profits and loss accounts ever since. Antonio Merino stated that the output had always been handed over to Domingo´s uncle, Francisco Callejo, who had managed the student´s maintenance during his University studies and before it. Given that Francisco Callejo had passed away, it was his widow, María Antonia de Castro, who faced her nephew´s claim. The money claimed totalled 12900 reals due to the discrepancies between the profits and what was handed over to the rightful beneficiary. María Antonia de Castro argued that her husband not only had borne (together with his brother) all of Domingo´s expenses during his whole education but also had paid for the licence that allowed the plaintiff the ownership of the profits. In order to prove the truth of what she asserted and her husband´s periodical money deliveries, she presented several receipts and twelve letters before the court. Despite the widow and the administrator´s allegations the court ruled in favour of Domingo de Angulo y Callejo, who had to be compensated by the defendants, although he had to bear the legal costs.

Mui sra mia rezivi la de Vmd de 26 del pasado con el testimo del papel de Dn Domingo de quien no me atrebo a dezir mas que no le tengo por sangre de mi difunto Amigo, aviendo escrito las cartas que no quisiera ver, i de algas remiti a Vmd copia, i me alegrare que no aia llegado a sus manos

Sra con grande cuidado me tenia el no haver visto respta de Vmd a mas de seis que e escrito despues que murio su marido i la prima por mano de Dn Domingo; aora quedo consolado pero en una carta se puede dezir poco ia sabra Vmd mi Amistad i Buena Correspa con su marido por mas de treinta años i asi puede Vmd si se le ofreze mandarme, i escribirme a la llana, lo que se ofrezca como lo hazia mi difunto Amigo

Dn Domingo me a ejecutado; i oi se me a requerido un despacho del Juez de la Unibd de Alcala, i e puesto por respta copia del testimo que Vmd me remitio que vino a buen tiempo i el sabado remitire otra copia a un canonigo de Alcala para que informe a el Juez, u vean quien es Dn Domingo, pero Pazienzia (Cria el Cuervo) creo que en vista del Papel lo dejara, si no es que quiera mortificarnos, diziendo de falsedad aunque lo sabe mejor que Vmd a quien no quiero Cansar mas i espero respuesta para mi consuelo por mi Amigo a quien Ds tenga en su Gloria i a Vmd la conserbe en Grazia ms as Toro i Junio 2 de 1751
