Letter from Francisco González de Arce to Domingo Antonio de Angulo y Callejo, a student at Santa Catalina.

The author informs Domingo de Angulo y Callejo of the arrangements he has made regarding his lawsuit and asks him to send him further instructions for results achieved.

In May 1751, Domingo Antonio de Angulo y Callejo initiated a litigation against Antonio Merino, a canon from the collegiate church of Toro. Antonio Merino had been the administrator of the profits in the vicinity since 1735, and Domingo Angulo y Callejo asked to be updated of the profits and loss accounts ever since. Antonio Merino stated that the output had always been handed over to Domingo´s uncle, Francisco Callejo, who had managed the student´s maintenance during his University studies and before it. Given that Francisco Callejo had passed away, it was his widow, María Antonia de Castro, who faced her nephew´s claim. The money claimed totalled 12900 reals due to the discrepancies between the profits and what was handed over to the rightful beneficiary. María Antonia de Castro argued that her husband not only had borne (together with his brother) all of Domingo´s expenses during his whole education but also had paid for the licence that allowed the plaintiff the ownership of the profits. In order to prove the truth of what she asserted and her husband´s periodical money deliveries, she presented several receipts and twelve letters before the court. Despite the widow and the administrator´s allegations the court ruled in favour of Domingo de Angulo y Callejo, who had to be compensated by the defendants, although he had to bear the legal costs.

Mui sor mio y Paisano; consiguiente, a luego que recibi el despacho y la carta de el señor Merino, Vicario y Juez eccco en esta Ciud de Toro, le puse en M de Joseph Fuentes de el Hoyo, en el mesmo dia de su recibo, o siguiente y haviendole noticiado a dho señor Dn Antonio Merino le respondio segun me dijo se hallaba, al presente ocupado pr una beemencia de un señor Clerigo (lo qe en realidad fue asi) y que su declarazon precederia para el siguiente, o subsiguiente correo, y haviendole apurado desde el dia de antes de ayer para que tubiese efecto para el Correo de oy, bino en la tarde de este dia, y a presencia del expresado mi señor tio y de Da Maria de Obregon Chabarria, me dijo que el señor Bicario le havia manifestado no debia hazer tal declarazion lo primero prque no hera su Juez el de esa Unibersidad, y sobre cuyo asumpto le havia manifestado una cartta de Zamora del antezedte Señor Probisor de este Obispado; lo segundo prque el egercia la Jurisdicion de Juez eccco de este Juzgado; y lo tercero porque tenia su Juez quien no se lo mandaba y haviendole suplicado que para ebaquar mi encargo con la formalidad debida se sirbiese poner la notificacion y respta de dho señor Vicario se nego a todo y por si por otra parte podia conseguirlo, me bali, en este mismo dia de el essno Gaspar Sanchez de Arzilla para que notificase e hiziese saber el nominado despacho a el espresado señor Vicario Merino, se nego tambien absolutamente a ello; en cuya bista se le debuelbo a Vm para que en su virtud y de lo acaezido tome las Probidencias, qe halle pr convtes ynterin yo quedo pidiendo a nro señor ge su vida ms as Toro y Agosto 20 de 1755.
