Letter from Juan Manuel Araújo Somoza, a law official, to José de Santa Marina.

The author warns José de Santa Marina of the risks his father faces by accepting the position as a law official he sold him.

The plaintiff of this litigation from 1777 was Juan Manuel Araújo Somoza, a public notary official native to Chantada (Lugo), against Domingo de Santa Marina Noguerol, also a law official. The litigation was issued regarding compliance of an instrument on obligation. Juan Manuel Araújo Somoza accepted the position as a law official in the jurisdiction of Camba y Roseiro (Pontevedra) when his uncle, José Araújo, renounced it. Juan Manuel Araújo Somoza worked at the said position between 1766 and 1773. In 1773, the plaintiff and the respondent signed an instrument on obligation whereby Juan Manuel Araújo Somoza handed the position as a law official to Domingo de Santa Marina Noguerol and the latter committed to pay the former a pension of one hundred ducats per year. The litigation started because Domingo de Santa Marina delayed in the payments since the very first day he took office, in August the 22nd 1774. There are four letters attached to the process documentation: the three first letters (PS6108, PS6109 y PS6110) were presented by the respondent in order to prove that Juan Manuel Araújo Somoza was aware of the abusive character of the instrument on obligation. He argued he had been fooled and he had been notified about the news referred to in the letters after having accepted the position and having spent a lot of money. Besides, he also argues no one informed him of the low income he would have from the position. The fourth letter (PS6111) was presented by the plaintiff in order to prove that Domingo de Santa Marina Noguerol was fully aware of the conditions of the instrument on obligation, therefore, he never had any intention on fooling him. In this letter an annotator has modified the sentence "la vida del señor su padre" ("his father´s life") for "su vida" ("his life") (fl. [13]r, línea 5).

Mi maior Dueño, vmd ya estara savedor por medio del señor su pe de que yo hize renuncia a su favor de esta escribania de Camba con la obligacion de satisfazerme annualmte cien ducados durante la vida del señor su Padre quien se obligo por ynstrumento a la paga de esta pension y devio al mismo tiempo entrar vmd como hixo primojenito afianzando con mi sra su Madre a fin de que quedase yo con la seguridad, que correspondia, segun me pareze hera justo, pues asegurandole la escribania tambien se devia executar con la pension, y libertarnos de embelecos, y enriedos para lo subcesivo; yo bien se, que el Señor su padre y todos vmds segun sus circunstancias no faltarian a lo pactado, y que no hera bueno hera necesario precediese fianza, pero halto, qe para mantenerse un hombre de toda onrra, con su familia a costa solamte de lo que puede dar de si el Poio, y pagar los cien ducados, sera con gran determto de su pna y sudando gotas de sangre, y con todo esto no podra alcanzar y siempre sera vivir con penuria, y por lo mucho que yo, Padres, y hermanos, estimamos al señor su padre y a vmds no quisiera que saliera engañado ni el, ni yo esperimentasemos ninguna bexacion, ni perjuicio, pues le aseguro a vmd que todo quanto a mi me bale este poio es mi manutencion; la del oficial, criada, y cavalleria, todo se va d esta manera, comido por servido, y a
